GENERAL CONDITIONS OF CARRIAGE
of the shipping company Frankfurter Personenschiffahrt Anton Nauheimer GmbH
1. Applicability
1.1 These General Conditions of Carriage apply to the purchase of tickets from Reederei Frankfurter Personenschiffahrt Anton Nauheimer GmbH (hereinafter referred to as “Primus-Linie”), regardless of whether these are purchased by the customer directly at the respective landing stages, at the Primus-Linie office, or online via the website www.primus-linie.de.
1.2 By purchasing a ticket or, at the latest, by boarding a Primus-Linie vessel and using Primus-Linie's services, the customer accepts these General Conditions of Carriage. They become an integral part of the corresponding contract between Primus-Linie and the customer.
1.3 The General Conditions of Carriage apply exclusively. Any conflicting or deviating general terms and conditions of the customer shall only become part of the contract if they correspond to the content of these General Conditions of Carriage or have been expressly accepted in writing by Primus-Linie.
This shall also apply if Primus-Linie provides services without reservation in the knowledge of conflicting or deviating terms and conditions of the customer.
2. Details regarding the online ordering process and conclusion of contract
2.1 The trips with Primus-Linie shown online on the website do not constitute a binding contractual offer, but rather an invitation to place an order.
2.2 Once you have found the desired trip, you can add the corresponding ticket to your shopping cart without obligation by selecting the desired number and calculating the price, then clicking on the “Add tickets to shopping cart” button, which will be displayed as you continue with your order. The tickets in the shopping cart are not reserved, but can only be booked subject to availability.
You can delete the contents of the shopping cart at any time by clicking on the “x Empty shopping cart” button. If you wish to order the tickets in the shopping cart, click on the “Proceed to checkout and pay for tickets” button.
Please enter your details. Mandatory fields are marked with an asterisk (*).Registration is not required. After entering your details and selecting the shipping and payment method, you will be shown a summary of your order, where you can check your entries again. Here you can correct any incorrect information by clicking on the “edit” button. You will also find further information on the individual pages, e.g. on correction options. By clicking on the “Buy ticket(s)” button, you are placing a binding order. You will then be asked to provide us with your payment details.
2.3 We can accept your order by sending the tickets ordered when you choose the purchase and shipping option. If you choose to collect the tickets yourself, acceptance is effected by handing over the tickets. In the case of “Print@Home,” acceptance is effected by printing the tickets or downloading them to the wallet. Confirmation of receipt of an order placed via the website is provided by an automated email immediately after the order is submitted and does not constitute acceptance of the contract.
2.4 We are entitled to refuse to conclude a contract with the customer.
3. Tickets and prices
3.1 Tickets are sold at the landing stages in Frankfurt, Mainz, and Wiesbaden, on board the ships, and through the Primus-Linie office. Tickets can also be ordered via our website at www.primus-linie.de. You can print the tickets you have purchased using our “Print@Home” tool or load them into a wallet on a mobile device.
3.1.1 Online tickets cannot be combined with discounts, discount vouchers, advance tickets, or other promotional offers, proof of which must be provided directly on site.
3.2 The fare is based on the price list valid at the time the contract is concluded.
The prices quoted include statutory value added tax and other price components and do not include any shipping costs that may be incurred.
3.3 Tickets are transferable to another person until the start of the journey, provided they are not issued in a specific name or purchased at special rates. If tickets are marked with a specific date, they are only valid for the specified time.
3.4 Tickets must be presented personally and openly when boarding and alighting, kept during the journey, and presented on board for inspection upon request.
3.5 The group ticket serves as the tour guide's ticket. The tour guide must board the ship first, followed immediately by the group.
3.6 Anyone who boards the ship without a valid ticket or loses their ticket during the journey and cannot otherwise prove that they have already purchased a ticket must report to the ship's personnel without being asked to purchase a replacement ticket. In the event of a culpable violation of one of these provisions, the passenger must pay the fare plus the corresponding surcharge in accordance with the price list valid at that time.
3.7 The resale of tickets purchased from Primus-Linie at a price higher than the final price stated on the ticket is prohibited. Commercial resale is not permitted. Any violation of these conditions will result in the loss of access to the respective event without compensation. The ship tickets will lose their validity.
4. Shipping costs and delivery terms
4.1 A shipping fee will be charged in accordance with the shipping cost list valid at the time of ordering, depending on the delivery method you have selected.
4.2 Unless otherwise stated, the delivery time is usually approx. 5-7 days from receipt of your order.
5. Terms of payment
5.1 Payment can be made online by credit card, online bank transfer, PayPal, or on account (for orders over EUR 30.00). If you collect your order yourself, you can pay in cash, by debit card, or by credit card.
5.2 Invoice amounts must be transferred to our account immediately upon receipt of the invoice.
When paying by credit card, online transfer, or PayPal, your account will be debited shortly after you have provided your payment details.
5.3 If you are in default of payment, we are entitled to charge interest on the corresponding amount at a rate of 5 percentage points above the base rate during the period of default. We expressly reserve the right to assert further claims for late payment.
5.4 Tickets that are not collected will be invoiced at a fee of EUR 3.50.
6. Transportation of vehicles, luggage, and other items
6.1 Cars, motorcycles, rowing boats, and paddle boats will not be transported.
6.2 Passengers' strollers, bicycles, and wheelchairs will be transported free of charge on board, subject to the available space. The ship's crew may assign a specific place for the storage of such vehicles.
6.3 Weapons, flammable, corrosive, and other dangerous items, as well as items whose possession is prohibited or punishable by law, will not be transported. If such items are discovered during the voyage, the ship's management may take them into custody and remove them from the ship at the owner's expense at the next port of call.
6.4 The transport of live animals is prohibited unless expressly agreed. Dogs may be permitted on our Frankfurt tour, Seligenstadt tour, and day trips (except for the Heidelberg day trip) provided that this does not
(a) compromise the safety and order of the operation, and
(b) endanger or disturb other passengers.
Dogs must be supervised at all times by the respective passenger and kept on a short leash. Dogs that may endanger passengers must wear a muzzle. Dogs may not be placed on seats. There is no entitlement to transport dogs. Guide dogs accompanying blind persons are always permitted for transport. Live animals are not considered luggage within the meaning of these General Conditions of Carriage.
7. Special conditions of carriage
7.1 All passengers must follow the instructions of the ship's crew.
7.2 Passengers who persistently violate these General Conditions of Carriage, wilfully cause damage to property or otherwise disturb safety or order on board may be excluded from further travel, with simultaneous forfeiture of their ticket, without any claims arising from this. After their names have been established, they may be handed over to the authorities at the next ship landing stage where this is possible without delaying ship operations.
7.3 There is no obligation to consume food or drink on board. Food and drinks brought on board may not be consumed on board. At the request of the crew, passengers wishing to use the restaurant facilities must be given a seat in the salons. There is no general entitlement to a seat.
7.4 Each passenger is responsible for ensuring that they leave the ship in good time at their destination. Passengers who wish to board or disembark at intermediate stops must inform the ship's crew of their intention in good time.
7.5 Any items found on board must be handed over to the ship's crew immediately. There is no entitlement to a finder's reward. Lost property will be stored in accordance with legal regulations. The owner must report the loss to Primus-Linie immediately. Primus-Linie does not actively search for the owner. Items left behind will only be returned at the request, risk, and expense of the owner.
7.6 The ships open half an hour before departure, except if the ship only makes one stop for boarding or disembarking or if the timetable indicates otherwise.
7.7 Each person present is liable for any damage they cause.
7.8 The shipping company reserves the right to refuse entry to persons who are heavily intoxicated or those with inappropriate clothing or behavior. In such cases, the fare will not be refunded.
7.9 Bags may be checked upon entry.7.10 Transportation on the shipping route can only take place within the framework of existing public regulations. Primus-Linie reserves the right to deviate from the contractually agreed scope of services with regard to transportation by adjusting the route, insofar as this is necessary due to force majeure, such as fog, ice drift, high or low water, accidents, closure of waterways or locks, or similar circumstances beyond its control, taking into account all circumstances, and is reasonable for the customer, taking into account their interests. The adjustment may also result in a shortening of the route or in the ship remaining at a berth, possibly at a different berth than originally planned. In the event of a change to the contractually agreed scope of services, Primus-Linie will take the customer's interests into account appropriately. There is no entitlement to a reduction in fare or refund in this respect. If the cruise is canceled by Primus-Linie due to the impossibility of providing the service, Primus-Linie shall be released from its obligation to perform and the customer shall be refunded the fare upon return of the ticket. At their discretion, the customer may also participate in an equivalent cruise within the current program, subject to availability.
7.11 Program subject to change.
8. Liability
8.1 The statutory liability provisions apply, taking into account the following provisions.
8.2 Primus-Linie is liable in accordance with the statutory provisions for physical injury, loss or damage to luggage, damage caused by malicious behavior, and damage caused by intent or gross negligence on the part of its legal representatives or vicarious agents. Otherwise, unless otherwise agreed and unless the statutory provisions contain any further limitations of liability, Primus-Linie shall be liable for damages limited to the amount of the foreseeable damage typical for this type of contract for damages resulting from a slightly negligent breach of essential contractual obligations or cardinal obligations. Cardinal obligations within the meaning of this provision include obligations whose fulfillment is essential for the proper execution of the contract and on whose compliance the customer may regularly rely. Otherwise, liability for damage caused by slight negligence is excluded.
8.3 For all claims not relating to physical injury, loss of luggage, or damage to luggage, liability is limited to three times the fare,
a) provided that the damage to the passenger was not caused intentionally or through gross negligence;
b) insofar as Primus-Linie is solely responsible for damage incurred by the passenger due to the fault of a service provider, unless Primus-Linie acted intentionally or with gross negligence in selecting the service provider.
8.4 Passengers are required to report any damage of any kind that could give rise to claims against Primus-Linie and its personnel to the responsible persons on board immediately after its discovery, but no later than upon leaving the ship at the destination, so that any necessary findings can be made without delay. Reporting damage at a later date does not result in the exclusion of claims for damages.
This does not apply if the exclusion results from statutory provisions.
8.5 Primus-Linie does not guarantee adherence to the applicable timetable. Deviations from timetables due to high or low water levels, high passenger volumes, and other traffic disruptions caused by operational disruptions or interruptions for which Primus-Linie is not responsible do not justify claims for reimbursement or reduction of the fare.
9. Data protection
The personal data of buyers is collected, processed, and used in compliance with data protection law to the extent necessary for the performance of the contract. Primus-Linie is entitled to pass on the data to natural or legal persons who perform the contract or are significantly involved in the performance of the contract. Detailed information on this can be found in our privacy policy at www.primus-linie.de.
10. Rebooking/Cancellation
10.1 Booked tickets and vouchers are generally binding bookings.
10.2 Cancellation policy: There is generally no entitlement to return or refund tickets, admission tickets, or vouchers for third-party services. For services in the area of leisure activities with a fixed performance date, in particular the sale of tickets for events, there is an exception to the right of withdrawal and return otherwise applicable to distance selling transactions in accordance with Section 312 g (2) sentence 1 no. 9 of the German Civil Code (BGB). Every order is binding upon conclusion of the contract and obliges the customer to accept and pay for the goods.
10.3 No refunds, no rebookings, and no exchanges for trips not taken or terminated prematurely by the customer.
10.4. Valid for the “Winter Magic on the Main” trip:
Individual bookings – we offer the option of rebooking subject to availability in the same calendar year. Cancellations are free of charge for individual tickets up to 7 days before the event.
For group bookings of 15 adults or more, the following applies: Cancellation 13 to 7 days before the event 50%, 6 days to 1 day before until 12:00 noon (only in written form by email to mail@primus-linie.de) 75%. For cancellations at shorter notice, the cancellation fee is 100%.
11. Validity of vouchers
Vouchers (travel vouchers and gift vouchers) are valid until the end of the third year after purchase. After this period, the vouchers lose their validity and can no longer be redeemed. Cash payment or partial repayment of gift vouchers is excluded. Vouchers are only intended for the specified purpose. We accept no liability for lost or stolen vouchers. Legal recourse is excluded.
11. 1 Redeeming vouchers
For all trips except the round trip in Frankfurt, prior registration by email to mail@primus-linie.de is required, unless the voucher has a specific validity date for a trip.
Once the booking has been confirmed, the cancellation conditions in accordance with point 10 apply. You can board directly with your trip vouchers. It is not necessary to exchange them for a boat ticket. In case of no-show, the trip voucher must be returned to us by registered mail. Otherwise, the trip will be charged plus a processing fee.
If a specific validity date is noted on the voucher, the voucher is only valid for the date of travel indicated on it. Registration for this trip was already made at the time of purchase.
Vouchers can only be redeemed at the ticket offices on site. The desired trip must also be booked in advance by email or online (only possible for “self-collection” and “payment on site,” not for other shipping and payment options). Once the booking has been confirmed, the cancellation conditions in accordance with point 10 apply. Payment must be made on site (either at the ticket offices at the piers or on board).
12. Image and sound recordings
Film and sound recordings as well as photos may be made by Primus-Linie or third parties at events of any kind. These recordings may be used for marketing purposes and press and public relations work by Primus-Linie and third parties, as well as for publication on social media and on third-party digital media. Image and sound recordings will only be made and used in compliance with the GDPR and the KUG (Austrian Art Copyright Act). The customer has the right to revoke consent at any time for recordings in which they can be identified.
13. Final provisions
The legal relationship between the customer and Primus-Linie is subject to the laws of the Federal Republic of Germany.
